Environmental Compliance and Regulation
We provide wide ranging pan-European environmental advice on a diverse range of issues such as: site closures, permitting problems, compliance with existing and new EU laws, green procurement and risk management measures across portfolios of properties.
Many of our clients in the transport, industrial and chemical sector have for example also needed advice recently on the REACH regulation, along with the trans-frontier shipment of waste regulations and site closures, as well as operational matters such as permitting issues.
Examples of our experience are as follows:
- advising a number of different manufacturing clients on site closures, involving a range of issues from negotiation and liaison with environmental and health and safety regulators, surrender of permit and lease negotiations with landlords or tenants to advice on contamination related liabilities and onwards disposal of the sites
- advising Gypsum Products Development Association, Eurogypsum and gypsum sector company on whether flue gas desulphurisation gypsum is waste, including negotiations on drafting of Waste Framework Directive and associated by-products case study and obtaining Agency decision that FGD gypsum is not waste
- advising a major electronics manufacturer on Waste Electrical and Electronic Equipment (WEEE) Directive and Restriction of Hazardous Substances (ROHS) Directive, including specific advice relating to printers and cartridges
- advising a major sanitary goods manufacturer on definition of importer in REACH Regulation, the implications of Pre-registration and Registration for group marketing structures, and drafting suitable disclaimers
- advising a chemical risk assessment consultancy on REACH Only Representative contracts and Consortium Agreements to be used for several key sectors, and drafting groundbreaking model agreements and supporting documentation
- advising an international chemicals company on a wide range of regulatory issues, including specific waste and EU regulation issues
- acting as sole EHS advisor to WS Atkins plc, the leading multinational consultancy and support services company, providing regulatory advice, defence of prosecutions and training
- advising international gypsum products company on potential liabilities arising from Mining Waste Directive and the Sulphur Content in Liquid Fuels Regulations
- advising the Ministry of Defence on green procurement and environmental and sustainability in multi-billion pound defence procurement project
