Water

Our team has advised the Government on water law issues, managed major legislation for the water sector, negotiated EU Water Directives, drafted statutory instruments on water regulation, defended infraction proceedings on water law issues and advised on all aspects of water industry and water supply and regulation policy issues.

Burges Salmon has led the legal input on a UKWIR project with SKM Enviros and water industry companies on the impacts of the forthcoming Industrial Emissions Directive on the Water Industry.

We have been represented on the working group developing an RICS Information Paper on the Valuation of Water, launched in January 2011.

We have helped to negotiate and draft ground breaking viable contracts to facilitate water abstraction licence trading, with comparative studies of old and new legislation and extensive discussions with the Environment Agency.

Our work includes providing advice to major companies such as Wessex Water plc and Bristol Water plc, as well as work on defence to criminal prosecutions for water pollution and abstraction cases, together with a number of civil claims. We have advised extensively on the extent of the statutory powers of water undertakers.

We have spoken at the annual Climate Change and the Water Sector conference for the Chartered Institution of Water and Environmental Management and the 4th European Water and Wastewater Management conference in Leeds and advised a number of water companies on the carbon reduction commitment and other energy and emissions management issues, including anaerobic digestion.

Other litigation experience includes conducting litigation about water issues on behalf of the Government at national and EU levels, many aspects of flooding claims and advice on emerging issues such as climate change litigation.
