The new Family Procedure Rules 2010

On 6 April 2011, the new Family Procedure Rules 2010 will come into effect.  These are a new set of rules which codify and unify the existing Family Proceedings Rules for all family proceedings from the Magistrates' Court to the High Court.

There is a stronger emphasis on the courts' role within family proceedings, both in terms of case management and mediation.  There is also a new Part 25 which relates to experts, which will replace CPR Part 35. The Practice Direction that accompanies Part 25 has just been published.

Family Partnerships

Since the changes to inheritance tax in 2006, advisors have been talking about the advantages of using family partnerships
(FPs) as an alternative. FPs are seen to offer many of the same features as trusts, but (crucially) without an immediate 20% inheritance tax charge on their creation.
