Landowner Experience

Surplus land disposal

Advising one of the major UK racecourses in the proposed disposal of surplus areas of land for approximately 1500 units of residential accommodation. Critical to this was the requirement to balance competing demands of maximizing value and maintaining and enhancing the racecourse business. We also negotiated an access to the development over the adjoining railway.

Leasing a mineral water spring

Acting for a landowner in the Midlands on the grant of a long lease of a mineral water spring to a multinational drinks corporation.

Phased residential development

The disposal of the third phase of a large residential scheme in Dorset to Persimmon. We also acted on the disposal of the earlier phases to Persimmon and in selling land for employment use adjoining the development. In each case the land ownership was complex, being owed in part by various members of the same family or family trusts. We also acted for the farming company tenant.

Hybrid agreements

Acting for a Trust on the grant of a hybrid option and promotion agreement over approximately 100 acres of land for residential development in the South East to a consortium of developers.

Landowners

Acting on behalf of numerous landowners in connection with the grant of options over smaller sites in favour of individual developers, Westbury Homes, Countryside, Wilcon, David Wilson Homes, Hannick Homes, Barratt, Crest, Pelham Homes, Lovells and Redrow.

A consortium of landowners

Acting for a consortium of landowners in a proposed option in relation to 120 acres of land.  Devising a structure for pooling of land for tax purposes to enable each landowner to derive proportionate benefits at all stages of the development without a tax charge at the point of pooling.

A consortium of 13 landowners

Acting as lead lawyer on behalf of a consortium of 13 landowners on the grant of an option over approximately 1000 acres for the creation of a major new settlement in South Devon
