European Law and Subsidies

The European legislative process and in particular the Common Agricultural Policy (CAP) and subsidies have a direct impact on farming and the wider rural economy in this country. Burges Salmon’s expertise in subsidies originated in the introduction of milk quotas in 1984 and the disputes which inevitably followed.

The team is led by Partner William Neville, who specialises in CAP related issues and is the joint author of Mid Term Review – A Practical Guide and A Guide to the Reformed Common Agricultural Policy

We have acted in many of the leading cases in the UK and the European Court of Justice.

Cases include:

  • A ruling that the Government's method of allocating subsidies was unlawfu;
  • A ruling that the European Commission's penalty system was unlawful;
  • The leading cases determining the legal characteristics of quotas, entitlements and single farm payments.
