Rural Property
The rural property team comprises six lawyers acting exclusively on rural sales, purchases and mortgages. They regularly deal with all of the major rural land agents throughout the country, advising on the numerous and varied issues arising from the sale and purchase of estates and large rural properties.
With the gradual resolution of the Single Payment Scheme and the continued buoyancy of the agricultural market, the rural property team, led by Alastair Morrison (see Our People), has enjoyed a strong flow of instructions from across the country.
There have been a number of "life style" acquisitions by newcomers to farming, but the majority of instructions have revealed an increased interest in the investment opportunity from farmland. This is also shown by an increasing amount of time spent advising upon development clawback structures and on the imposition and enforcement of restrictive covenants.
The unit has also been heavily involved in all aspects of secured lending in the agricultural sector, including acting for High Street banks in high value security reviews.
Other issues frequently encountered relate to development clawback, options and pre-emption, restrictive covenants, rights of way and leases of agricultural, commercial and residential property.
