Michael is an Associate in the Environmental Law Unit. He is responsible for environmental litigation which includes:

private and public nuisance claims
statutory nuisance
defending enforcement proceedings by the Environment Agency
injunctions and declaration proceedings
professional negligence
easement claims and rights of way
flooding claims
judicial reviews
contractual disputes
Human Rights

Recent projects include:

successfully appealing an abatement notice for a rail franchisee on a statutory nuisance claim arising from noise at its depot including the availability of statutory defences and potential liability under the Human Rights Act 1998
advising a major car manufacturer on claims against its neighbour arising from deposits carried onto its land from the neighbour's land
advising a major energy company about liability for subsidence from boreholes
advising a farmer about claims against DEFRA arising from environmental damage to his farm from the burying of carcasses and ash during the Foot and Mouth crisis including claims under the Human Rights Act 1998. R (on the application of Feakins) –v- Secretary of State for the Environment, Food and Rural Affairs [2004] 1 WLR 1761, [2003] Env L.R 20 and [2003] EWHC 033
taking to trial and settling a claim for environmental damage for a major utility company using a novel cause of action arising under the Environmental Protection Act.
advising a landowner in relation to flooding to his land by water and sewage including potential claims under the Human Rights Act 1998
advising a company in relation to a warranty / indemnity claim arising from the terms of the Sale Agreement by which it bought another company.
advising a landowner in relation to his claim for compensation under the Electricity Act 1989

Michael is a regular contributor to journals such as Environmental Liability and Environmental Information Bulletin and regularly lectures on Environmental Litigation issues.
