Farming Partnerships
This specialist area of law has been central to our practice in the agricultural sector for over thirty years. Farming partnership disputes are invariably complex, involving the multi-layers of partnership and property law (see Agricultural Property Disputes), as well as tax (see UK Tax and Trusts Advice to Rural Landowners and Farmers) and agricultural subsidies (see Agricultural Subsidies).
Partners Peter Williams and Vivienne Williams (see Our People) lead this area on the contentious side. Under their authorship, the 9th edition of Scammell and Densham has an extensive section on Farming Partnerships.
The focus is upon dispute resolution, avoiding litigation in relation to what are often family disputes. Sometimes disputes result in litigation. Where they have, our cases include:
- Faulks v. Faulks: the rights of partners to milk quota upon dissolution of a partnership
- Gratton Hughes v. Ellis: a partner's entitlement to have assets on account of his share upon dissolution of a partnership
On the non-contentious side, Nicola Horrocks and Tom Hewitt (see Our People) each enjoy an enviable reputation in this specialist area.
